1. Services

Elevate Systems provides customer relationship management (CRM) software, automation, communication tools, and related business services for contractors and other businesses.

Our services may include:

CRM software

Lead management

Automated SMS and email messaging

Appointment scheduling

Sales pipelines

Forms and surveys

Website or landing page tools

Reporting and other business automation features

We reserve the right to improve, modify, or discontinue features at any time.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use our services.

3. Account Responsibilities

You are responsible for:

Keeping your login credentials secure.

Providing accurate account information.

Maintaining the confidentiality of your account.

All activity occurring under your account.

You agree not to use the platform for unlawful purposes, spam, fraud, or activities that violate applicable laws.

4. Pricing and Payment

Current pricing is:

One-Time Setup Fee: $297 USD

Monthly Subscription: $297 USD per month

All fees are charged in U.S. Dollars.

Monthly subscriptions automatically renew unless canceled.

Failure to make payment may result in suspension or termination of your account.

5. Refund Policy

The setup fee covers onboarding, configuration, and implementation work and is non-refundable once work has begun.

Monthly subscription payments are generally non-refundable once billed.

If you believe a billing error has occurred, please contact us and we will investigate promptly.

6. Cancellation

You may cancel your subscription at any time.

Cancellation prevents future recurring charges but does not automatically generate refunds for previous payments.

Access to the platform may terminate at the end of your current billing period.

7. Customer Data

You retain ownership of the information and data you upload to the platform.

You grant Elevate Systems permission to store, process, and transmit that data solely for the purpose of providing our services.

You are responsible for ensuring that your use of customer information complies with applicable privacy laws.

8. SMS Communications

If you choose to opt in to receive SMS messages from Elevate Systems LLC, you agree to receive non-marketing text messages related to our services (Appointment confirmations, missed call follow up). Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact us at [email protected].

Mobile carriers are not liable for delayed or undelivered messages. For additional information regarding how we collect, use, and protect your information, please review our privacy policy.

9. Availability

We strive to provide reliable service but do not guarantee uninterrupted availability.

Maintenance, updates, internet outages, third-party providers, or unforeseen events may temporarily affect service availability.

10. Third-Party Services

Our platform may integrate with third-party providers, including but not limited to payment processors, email providers, SMS providers, and CRM service providers. We are not responsible for outages, errors, pricing changes, or policies of third-party services.

11. Acceptable Use

You agree not to:

Send spam or unsolicited communications.

Use the platform for illegal activities.

Attempt to gain unauthorized access to our systems.

Interfere with or disrupt platform operations.

Upload malicious software or harmful content.

Violation of these terms may result in immediate suspension or termination.

12. Limitation of Liability

To the maximum extent permitted by law, Elevate Systems LLC shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use the service.

Our total liability for any claim shall not exceed the amount paid by the customer during the three (3) months preceding the event giving rise to the claim.

13. No Guarantee of Results

While our CRM is designed to help businesses organize leads and improve operations, we do not guarantee:

Increased sales

Increased revenue

Lead generation

Business growth

Specific financial results

Business success depends on many factors outside our control.

14. Termination

We reserve the right to suspend or terminate accounts that violate these Terms of Service or applicable laws.

15. Changes to These Terms

We may update these Terms of Service from time to time.

Continued use of the service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Idaho, without regard to its conflict of law principles.
